These general terms outline the terms of use of the site, including the purchase and ordering of products and services from “BUMI” through the website, as well as the rights and obligations of users of the site.

Please read these terms carefully, as they constitute a binding agreement between you and “BUMI.” By using the site, including when ordering products and/or services through the site, you indicate that you are aware of the general terms and other terms of use available on the site concerning the products and services offered, particularly the site’s privacy policy (together: “Terms of Use”) and that you agree to their provisions.

These Terms of Use govern the use of the site and the products and/or services and/or programs offered on the site only and will also apply in addition to the terms and conditions applicable to BUMI products displayed on the products.

The Terms of Use will apply in any case of using the site via any type of computer or other communication tool (e.g., mobile phone, laptop, etc.). Some parts of the site and the Terms of Use are phrased in masculine language for convenience only, but all references are directed toward all genders. The headings of the sections are provided for convenience and navigation only and will not be used for interpretation.

Using the Site

The use of the site is for private use only and not for the purpose of selling the products and/or services offered to third parties in group sales and/or wholesale. Commercial use of the site or any part of the information appearing on it will allow “BUMI” to take all legal measures available to it against such commercial use.

To use the site and make purchases, you must meet the following conditions, and by using the site, you declare that the following conditions apply to you:

• You are a resident of Israel, 18 years of age or older, holding a valid Israeli identity card or a legal entity registered in Israel, capable of acting and assuming obligations.

• You have registered on the site according to the provisions of these terms and as required in the registration form.

*If the purchaser is a minor (under 18) or not authorized to act without guardian approval, the use of the site will be considered approved by the guardian, who will be responsible for the legal consequences of the actions performed on the site and/or through it.

You are permitted to use the services of the site for legal purposes only. Purchase Process Through the Site

If you wish to purchase and order products and services from “BUMI” through the site, you must enter the required details in the registration form (hereinafter: “Purchase Details”). Only the fields explicitly marked are not mandatory. You must provide correct, accurate, and complete information to avoid any issues or delays in shipping. You hereby confirm the accuracy of the information you provided. “BUMI” will not use your details other than in accordance with the site’s privacy policy, which is an integral part of these Terms of Use.

Payments on the site can only be made using credit cards. You can cancel and revoke the order without any cost as long as it has not been finalized. Upon completing the ordering process, the system will process a request for approval from the credit card company for the purchase. Once approval is given by the credit card company, your order will be considered valid (hereinafter: “Final Approval”).

Without detracting from the above, “BUMI” reserves the right to prevent you from purchasing on the site and to cancel purchases made, even if you have previously ordered products and/or services through the site, either temporarily or permanently, in any of the following cases, at its sole discretion:

• If you provided false and/or incorrect information during registration on the site. It is hereby clarified that providing false information is a criminal offense, and “BUMI” will be entitled to take all legal measures available to it against any user providing such false information, including seeking legal recourse for damages caused or that may be caused to the site, “BUMI,” and/or any of its representatives.
• If the credit card is blocked or restricted in any way.
• If you owe money to “BUMI” or related companies and have not paid your debt, despite the payment deadline having passed.
• If there is a serious suspicion that you have committed an act or omission that harms or may harm the site and/or “BUMI” and/or third parties (including customers, employees, and suppliers of “BUMI”).
• If there is a serious suspicion that you have used the site illegally and/or used the site’s services to commit an act that appears to be illegal and/or to enable, facilitate, assist, and/or encourage the commission of such an act.
• If there is a serious suspicion that you have violated the Terms of Use and/or any other online service terms offered on the site and/or any additional agreement between you and “BUMI” and/or its representatives.
• If a technical failure occurs and/or a communication failure that prevents or could prevent a specific purchase.
• If there is an error in the description of the products, services, terms of services/terms of orders, terms of sale, and/or purchase details.
• In the event of force majeure, acts of war, hostility, terrorism, which prevent “BUMI” from continuing the sale, execution, participation in, or fulfillment of the order.

Notification of cancellation, cessation, or prevention as mentioned will be given to you, and “BUMI” will carry out the results of the cancellation in accordance with the law.

Payment and Payment Terms

Payment for the products will be made on the site using a credit card. You must provide the credit card number, the ID number of the cardholder, the type of card, and its expiration date. “BUMI” reserves the right to discontinue the use of any payment method on the site, to allow the use of additional payment methods, and to apply different payment arrangements for different types of credit cards or payment methods it accepts.

To ensure that the credit card details were provided with your consent and knowledge, “BUMI” may verify the name, address, and personal information provided during the registration process against third-party databases. During these verification checks, your personal details will be shared with third parties who may retain a record of this information, all subject to the privacy policy. Your order will not be shipped until payment or its approval is received, at “BUMI”‘s discretion.

If it turns out that your credit card is invalid, or that the credit card company does not approve the transaction, or that the requested product is out of stock, “BUMI” may contact you to complete or cancel the transaction, but is not obligated to do so. If the use of the credit card is approved by the issuing credit card company, you will receive appropriate notification, and your account will be charged for the service cost.

Liability

“BUMI” will fulfill its obligations to you upon delivering the products you ordered to the shipping address you provided during the order process. In case you purchased defective products, your sole right is to exchange them or receive your money back, as detailed in these terms. “BUMI” will not be liable for any damage, of any kind or nature, caused by delays in delivery or due to the supplied products being defective, unless the delay or defect occurred due to negligence on the part of “BUMI.” In such a case, “BUMI”‘s liability will be limited to the amount equal to your order.
